By accessing or using Pollarity ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Platform.
These Terms apply to all users of the Platform, including administrators, surveyors, and respondents.
Description of Service
Pollarity provides an online survey creation, distribution, and analytics platform. Our services include:
- Survey creation with multiple question types
- Survey distribution via secure links
- Response collection and management
- Real-time analytics and reporting
- Team management and surveyor assignments
- Data export capabilities
Account Registration
To use certain features of the Platform, you must register for an account. When registering, you agree to:
Accurate Information
Provide accurate, current, and complete information during registration.
Account Security
Maintain the security of your password and accept responsibility for all activities under your account.
Age Requirement
Be at least 18 years old or the age of majority in your jurisdiction.
Prompt Notification
Notify us immediately of any unauthorized access or security breach.
Acceptable Use
You agree to use the Platform only for lawful purposes. You must NOT:
Data Ownership & Responsibility
Your Data: You retain ownership of all survey content you create and all response data you collect. We do not claim ownership of your data.
Your Responsibility: You are solely responsible for:
- Ensuring your surveys comply with applicable laws (including GDPR, CCPA, etc.)
- Obtaining necessary consents from survey respondents
- The accuracy and legality of your survey content
- Proper handling and protection of collected data
Our License: By using the Platform, you grant us a limited license to process, store, and display your data solely for the purpose of providing our services.
Intellectual Property
The Platform, including its original content, features, and functionality, is owned by Pollarity and protected by international copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Payment Terms
For paid subscription plans:
- Billing: Subscription fees are billed in advance on a monthly or annual basis.
- Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
- Price Changes: We may change prices with 30 days' notice.
- Refunds: Refunds are handled on a case-by-case basis according to our refund policy.
- Taxes: You are responsible for any applicable taxes.
Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination:
- Your right to use the Platform will cease immediately
- You may request export of your data within 30 days
- We may delete your data after the export period
You may terminate your account at any time through your account settings or by contacting us.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLARITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Pollarity and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Your survey content and collected data
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pollarity operates, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting notice on the Platform
- Sending email notification
- Updating the "Effective Date" at the top of these Terms
Continued use of the Platform after changes constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
